1. Acceptance of these terms

Welcome to audioaccessible.ca (the “Site”), operated by Audio accessible, a non-profit social enterprise based in Montreal, Quebec. By accessing or using the Site, or by engaging Audio accessible’s services, you agree to be bound by these Terms of Use (“Terms”). If you do not agree, please do not use the Site or our services.

2. Our services

Audio accessible produces accessible audiobooks and magazines in DAISY 2.02 format for people with print disabilities, in partnership with library and rights-holder organizations serving people with print disabilities. Services are offered primarily to partner organizations and publishers.

Nothing on this Site constitutes an offer to produce content outside the scope of a signed agreement or purchase order with Audio accessible.

3. Eligibility

Our production services are intended for organizations serving people with print disabilities (including visual impairment, dyslexia, and physical disabilities that prevent reading conventional print), and for the narrators, freelancers, and volunteers who work with us. By using this Site or engaging our services, you confirm that you are authorized to act on behalf of the organization you represent, where applicable.

4. Intellectual property

  • Site content: The text, graphics, logos, and design of the Site are owned by Audio accessible or its licensors and are protected by copyright and other intellectual property laws. You may view and print Site content for personal, non-commercial reference, but may not reproduce, distribute, or modify it without our written permission.
  • Produced audiobooks and magazines: Audiobooks and magazines we produce are created under licenses, exceptions, or agreements applicable to the production of accessible-format works for persons with print disabilities (including applicable copyright exceptions in Canada). Underlying rights in the original works remain with the original authors, publishers, and rights holders. Accessible-format copies we produce may only be distributed and used in accordance with the terms agreed with the commissioning organization and applicable law.

5. Acceptable use

When using the Site, you agree not to:

  • use the Site for any unlawful purpose or in violation of these Terms;
  • attempt to gain unauthorized access to the Site, our systems, or related networks;
  • upload or transmit viruses, malicious code, or anything that could disrupt the Site;
  • misrepresent your identity or affiliation with any organization;
  • reproduce accessible-format content we produce outside the terms of the applicable license or agreement.

6. Third-party links

The Site may contain links to third-party websites (such as partner organizations). We are not responsible for the content, accuracy, or privacy practices of third-party sites, and inclusion of a link does not imply endorsement.

7. Accessibility

Audio accessible is committed to making this Site accessible in accordance with WCAG 2.1 Level AA guidelines. If you encounter an accessibility barrier, please contact us using the information in Section 11 so we can address it.

8. Disclaimer of warranties

The Site and its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by applicable law. We do not guarantee that the Site will be uninterrupted, error-free, or secure.

9. Limitation of liability

To the fullest extent permitted by applicable law, Audio accessible shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Site or our services. Nothing in these Terms limits liability that cannot be excluded under applicable Quebec or Canadian law.

10. Governing law

These Terms are governed by the laws of the Province of Quebec and the applicable laws of Canada, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts located in the judicial district of Montreal, Quebec.

11. Changes to these terms

We may revise these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
